What are the FCT and how to use them?
The FCT were established by Law No. 70/2013 with the objective of guaranteeing a financial reserve that could be used to pay compensation to workers in case of termination of the employment contract. These funds were mandatory for all companies with employment contracts covered by the aforementioned law.
Recently, with the extinction of the FCT, the use of the accumulated funds was reassessed. Now, companies that contributed to the FCT can use these funds to finance support measures for workers, including professional training. This change allows companies to invest directly in improving the skills of their employees, keeping them competitive and up to date with the best market practices.
The balance of each company in the FCT, where individual accounts per worker are merged into a single global account per company, can be mobilized under the following conditions:
- Between January 1, 2024, and December 31, 2026 (or until the date of the extinction of the FCT, if it occurs earlier)
- Up to 2 times, if the balance is less than €400,000
- Up to 4 times, if the balance is more than €400,000
This balance must be used by the date of the extinction of the FCT, still undetermined, regardless of the moments of mobilization of the balances.
The redemption request is made online, in Work Compensation Funds, indicating:
- The amount and purposes of the mobilization
- Identification of the beneficiary workers
- Declaration, under an oath of honor, proving the duty of consultation and the non-existence of a justified opposition from the workers
